Practice Focus

Matthew C. Elstein is a partner resident in Tressler’s Los Angeles office. Matt's practice focuses on three areas: (1) insurance coverage and insurance “bad faith” litigation; (2) complex business litigation; and (3) intellectual property disputes. 

In the insurance arena, Matt spearheads the defense of coverage and “bad faith” litigation involving complex insurance policies and programs, including general liability, "Coverage B" issues, environmental and pollution policies, D&O, technology and media/entertainment, commercial and residential first party, fiduciary coverage, inland marine, maritime, employment practices, and professional liability.  Matt also has handled complex subrogation matters.

In the commercial litigation arena, Matt has successfully defended both public and privately held corporations and their officers and directors against claims of unfair competition, securities law violations, improper corporate governance, and other business torts.

In the intellectual property arena, Matt handles entertainment industry “right of publicity” cases, trade secrets disputes, and copyright and trademark litigation.  He also has been trial counsel in several patent cases. 

Matt’s clients include insurance companies, insurance brokers, financial services firms, technology companies, media and entertainment companies, defense contractors, manufacturing companies, and other large and medium-sized businesses.


Professional Background

Matt combines two decades of experience in handling insurance coverage, insurance bad faith, and complex business litigation with superior skills as a fearless trial lawyer.  Matt began honing his trial skills before entering private practice while serving as a prosecutor with the U.S. Department of Justice.  Matt works closely with clients to develop cost effective strategies for resolving claims short of trial.  When trial is necessary, however, Matt's experience and confidence in the courtroom are assets for his clients in achieving favorable outcomes.   For example, Matt recently secured a defense verdict on bad faith and punitive damages claims in favor of his insurer client in a nine week federal court jury trial.  He also recently prevailed on behalf of another insurer client in a two month long first party insurance arbitration.

Matt is originally from Los Angeles, California.  When not trying cases, he spends time collecting antiquarian books and cheering his teenage son on in football.

Matt is called upon by his clients, the San Diego and Los Angeles County Bar Associations, and the American Bar Association to give presentations on various subjects related to insurance coverage, bad faith, and intellectual property, including claims handling issues, insurance regulations, bad faith defense strategies, business torts, product disparagement, and right of publicity claims.
