About the Session
Even when a third-party lawsuit includes both covered and non-covered claims, policyholders (and third parties) commonly advocate for full defense and full indemnity for the judgement/settlement without allocating to non-covered claims. Challenges arise when settlements or judgments offer no guidance on allocation. Panelists will look at recent legal decisions that offer insights for insurers in navigating the way to fair allocation and delve into the best practices for insurers in preserving coverage defenses and safeguarding their interests in light of these developments.
