Daniel R. Whiston and Xander M. Landy Secure Summary Judgment in Negligent Parental Supervision Case

Tressler attorneys Daniel R. Whiston and Xander M. Landy successfully defended parents in a negligent parental supervision lawsuit filed in Cook County, Illinois. A former teacher brought suit against her school district, several former students, and the students’ parents, arising out of the alleged misappropriation of the teacher’s private photos. The claims against the parents were premised on allegations that the child’s prior conduct made the alleged actions foreseeable to the parents.

After the close of discovery, Dan and Xander moved for summary judgment on behalf of the parents. They argued that the parents lacked knowledge of any specific prior conduct sufficient to place them on notice of the alleged behavior and that the parents were not in a position to control the child’s actions. The trial court agreed and granted summary judgment in favor of the parents.

“We are extremely happy to secure this outcome for our clients,”  said Xander M. Landy. “The ruling maintains the long-standing position that parents are not liable for the torts of their children merely because of the parent-child relationship.”
