Finally – Relief for Owners Who Have Had Squatters Take Up Residence! Senate Bill 1563 Approved by Governor Pritzker

Illinois Senate Bill 1563, known as the “Squatter Bill,” is a legislative response to the growing problem of squatters occupying residential properties in Illinois. The bill passed both chambers of the General Assembly with broad bipartisan support and is awaiting the governor’s signature. It is scheduled to take effect January 1, 2026.
Some key provisions:
- SB 1563 amends the Code of Civil Procedure to affirm that law enforcement officials are not prevented by eviction laws from arresting or removing squatters under the criminal trespass provisions of the Illinois Criminal Code.
- Previously, property owners who found squatters in their homes — often after being away for extended periods — were forced to go through a lengthy eviction process; during this time, squatters could legally remain on the property.
- The new law differentiates squatters and tenants, enabling police to take immediate action against unauthorized occupants if the owner can prove rightful ownership.
- This bypasses the months-long eviction process, allowing property owners to reclaim their homes much more quickly.
