Tressler attorneys Rick Capra and Jerome T. Murphy obtained a dismissal with prejudice on behalf of a national food manufacturer. The personal injury lawsuit was brought by an injured truck driver for personal and psychological injuries he allegedly sustained when a product load fell on him during the unloading process. The defense win hinged on procedural requirements for converting a respondent in discovery to a defendant under §2-402 and the relation back doctrine under §2-616 of the Illinois Code of Civil Procedure. Rick and Jerome successfully argued that plaintiff failed to comply with the provisions of §2-402, and that the relation back doctrine could not save his untimely claims.

Rick Capra is Chair of Tressler’s Litigation Practice Group.
