Tressler attorneys Rick Capra, Charles “Chuck” A. LeMoine, and Ryan L. Nolte recently represented a school district and achieved dismissals with prejudice from two companion cases pending in Kane County. The lawsuits arose from a horrific car accident in October 2023, in which a car driven by the co-defendant collided with the back of a school bus, killing two, and severely injuring another. Kane County Court granted Tressler’s motions to dismiss with prejudice with respect to both cases.

Kane County Court ruled that, despite multiple pleading attempts, the plaintiffs failed to state a willful and wanton claim against the district. The written decisions went on to state that, even if the plaintiff had been able to meet the willful and wanton standard, discretionary immunity under the Tort Immunity Act would have barred the claims.

This was a great team effort at Tressler, and we are proud to zealously defend our clients. Tressler’s attorneys fought plaintiffs hard at every turn, utilizing important tort immunity defenses. We are pleased that we were able to obtain this favorable result in two cases with potentially catastrophic damages.
