Mark T. Banovetz
Partner

Mark concentrates his practice in the areas of aviation, insurance coverage and general civil and commercial litigation, including construction, professional liability, tort litigation and appellate work. Mark’s clients benefit from his passion for aviation. He recently completed his FAA certification as a Commercial Pilot. Mark leads Tressler’s Aviation Practice Group and has been an instrument-rated private pilot for more than 22 years.
Daniel J. Cunningham
Of Counsel

Dan’s practice involves insurance coverage and bad faith litigation stemming from all sorts of underlying claims, including claims arising out of bodily injury, property damage, consumer protection statutes, privacy violations, defamation, intellectual property infringement, defective products and pollution. Dan has represented insurers in all aspects of litigation throughout the country. Additionally, Dan counsels insurers with regard to claim handling and underwriting issues.
Daniel R. Formeller
Chairman and Partner

Dan is Chairman of the firm. As a trial lawyer based in the firm’s Chicago office, Dan focuses his practice on business litigation and the resolution of business disputes through mediation and arbitration. Dan handles a wide variety of complex business litigation and counseling, including intellectual property, state and federal securities actions, anti-trust, ERISA, class actions and directors and officers liability matters. He has been lead trial counsel in bench and jury trials in state and federal courts throughout the United States.
Charles A. LeMoine
Partner

Chuck is a partner who provides client services in both Tressler’s Government and Litigation Practice Groups. He has a wide range of experience in representing school districts and other public entities in all aspects of federal and state litigation, arbitration, and other forms of dispute resolution. These include FOIA, OMA, breach of contract, civil rights, sexual abuse, premises liability, vehicular liability, construction-related claims and insurance, employee benefits and worker’s compensation to name just a few.
John M. O’Driscoll
Partner

John is a partner and Co-Chair of Tressler’s Government Practice Group. His practice includes representing companies and individuals in business disagreements and providing general counsel services to local governmental bodies such as municipalities, school districts, library districts and park districts. John handles a wide variety of disputes such as business litigation, breaches of contract, construction issues, employment disputes, property damage, tort liability defense, labor negotiations, internet defamation, ordinance violations, “sunshine laws” compliance, professional negligence matters and complex litigation.
Darcy L. Proctor
Partner

Darcy is a partner in Tressler’s Local Government Practice Group. Darcy concentrates her practice in the defense of local governments in all aspects of tort, civil rights liability and employment litigation. She also defends private sector employers across a variety of employment law issues. As a seasoned litigator, Darcy has taken dozens of cases to trial in both state and federal court.
Todd S. Schenk
Partner

Todd is a member of the firm’s three-person Executive Committee and partner in Tressler’s Insurance Services Practice Group. He is highly experienced in providing insurance coverage counseling and litigation representation to insurance companies. He is particularly skilled in handling third party claims involving advertising injury and product liability, and first party claims under residential and commercial property policies. Many of his cases require the defense of common law and statutory bad faith claims, which Todd litigates in venues around the country. He has also handled appeals in both state and federal courts around the country.
Jennifer L. Smith

Jennifer is a partner and Chair of Tressler’s Professional Liability Practice Group. In her two decades of representing clients in state and federal courtrooms, she has been engaged to litigate a wide range of disputes, including complex business litigation, the defense of professionals and executives, wrongful death actions, and aviation accidents. Her representation has included the defense of class actions and parties in multidistrict (MDL) toxic tort litigation. Jenny is a member of the Trial Bar for the United States District Court for the Northern District of Illinois.
Rosa M. Tumialán

Rosa is a partner and Co-Chair of Tressler’s Insurance Services Practice Group, Chair of the Appellate Team and a member of the firm’s national Diversity, Equity and Inclusion Committee. Rosa focuses her practice on insurance coverage and litigation. She is an accomplished defense attorney with more than twenty years of experience. Rosa’s insurer-related services include coverage opinion analysis and representing insurers in complex coverage disputes relating to personal and commercial lines, third party claims, surplus lines as well as claims handling practices and extracontractual liability. She has also litigated environmental coverage disputes throughout the Midwest for various insurers relating to superfund sites. Rosa assists with drafting coverage documents for insurance pools and counsels clients in the administration of same. Her practice also includes serving as national coordinating coverage counsel for insurance clients who rely on her to develop and implement strategies nationwide in response to pattern litigation. Rosa is an accomplished class action defense lawyer and appellate practitioner, having appeared and argued in both state and federal courts nationwide.

Daniel is a partner in Tressler’s Litigation Practice Group. An experienced litigator, Daniel handles all aspects of trial work and has taken complex jury and bench cases to verdict. He also represents clients in high-stakes arbitrations involving significant financial and business risks. His experience spans the full litigation process, including case evaluation, pleadings, written discovery, and depositions to expert engagement, motion practice, trials, and appeals. Known for his thoughtful advocacy, Daniel combines careful preparation with strategic judgment to effectively protect his clients’ interests.
